9th Circuit: If there is a claim of outrageous government misconduct, and the defendant is aware of the conduct, he must raise it in a pretrial motion. U.S. v. Mausali, No. 08-50062 (1-11-10).
9th Circuit: In an appeal from a conviction and 30-year sentence for ecstasy drug offense, the 9th (M. Smith joined by Hall and T. Nelson) affirm the conviction but remand for a new sentencing. U.S. v. Forrester, No. 09-50029 (1-5-10).
